Komsultant (“Komsultant”, “we”, “us”) respects your privacy. This policy explains what personal information we collect through komsultant.co.za, why we collect it, how we protect it and what rights you have under the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who we are

Komsultant provides accounting, tax, business advisory and business training services, as well as global commodity sourcing and chrome ore supply. We are the “responsible party” for the personal information described in this policy.

2. What information we collect

  • Information you give us: your name, email address, phone number, company name and the message you send when you use a contact or consultation form, email us or call us. If you become a client we also collect the information needed to deliver our services (for example identity, tax and financial information), which is covered by our engagement terms.
  • Newsletter details: your name and email address if you choose to subscribe to our mailing list.
  • Technical information collected automatically: IP address, browser and device type, pages visited, time on site and referring page, collected through cookies and similar technologies.

We do not knowingly collect information from children under 18, and we do not collect special personal information (such as health or religious beliefs) through this website.

3. Why we use your information

  • To respond to your enquiries and provide the services you ask for.
  • To send you information about our services, if you have subscribed or as otherwise permitted by law. You can unsubscribe at any time.
  • To keep the website secure and prevent spam and abuse.
  • To understand how the website is used so we can improve it.
  • To comply with our legal and regulatory obligations.

We process your information because you have consented, because it is necessary to carry out a contract or respond to your request, because the law requires it, or because it is in our legitimate interests (or yours) to do so.

4. Cookies and analytics

Our website uses cookies and similar technologies to work properly and to measure traffic. We may use Google Analytics (through Google Site Kit) to see, in aggregate, how visitors use the site. You can block or delete cookies in your browser settings, but parts of the website may then not work as intended.

5. Who we share your information with

We do not sell your personal information. We share it only with service providers who help us run the website and our business, and only as far as needed. These include our web hosting provider, Cloudflare (security and spam protection on our forms), Google (analytics), Mailchimp (email newsletters), and our image delivery service. We may also disclose information where the law requires it, for example to SARS or a court.

6. Transfers outside South Africa

Some of these providers store or process information on servers outside South Africa. Where this happens we take reasonable steps to make sure the recipient is bound by law, a binding agreement or corporate rules that provide a level of protection comparable to POPIA.

7. How long we keep your information

We keep personal information only for as long as needed for the purpose it was collected, or as long as the law requires (for example, tax and accounting records are kept for the periods required by South African legislation). Enquiries that do not lead to a client relationship are deleted within a reasonable time, and newsletter details are kept until you unsubscribe.

8. How we protect your information

We use reasonable technical and organisational measures to protect personal information against loss, damage and unauthorised access, including secure (HTTPS) connections, access controls and security software on the website. No system is completely secure. If a security compromise affects your personal information we will notify you and the Information Regulator as POPIA requires.

9. Your rights

Under POPIA you have the right to:

  • ask whether we hold personal information about you and request access to it;
  • ask us to correct or delete personal information that is inaccurate, out of date or unlawfully held;
  • object to the processing of your information, including for direct marketing;
  • withdraw your consent at any time (this does not affect processing that already took place); and
  • lodge a complaint with the Information Regulator.
